Mindscape Terms of Service
Introduction
Welcome to Mindscape! By using our platform, you agree to these Terms of Service (TOS). Please read them carefully before accessing or using the platform. These terms apply to individual professionals and organisational users, such as charities, businesses, and other entities using Mindscape services.
Eligibility
Mindscape welcomes therapists, counsellors, and mental health professionals, as well as organisations supporting mental health initiatives, to join our platform.
Individual Membership: Professionals are eligible to join Mindscape, regardless of location, as long as they comply with the platform’s terms and conditions.
Organisational Membership: Charities, businesses, or other organisations may register accounts to facilitate access for their staff or to list services offered under their brand, subject to these terms. Organisations must designate an authorised representative to manage their account and verify compliance with eligibility criteria.
Public Listing Requirements for Individuals:
Therapists wishing to list a public profile must meet the following criteria:
Hold UK-recognised qualifications in mental health practice (e.g., Level 4 or Level 5).
Be a member of a UK-recognised professional body such as BACP, UKCP, HCPC, or APA.
Provide verifiable evidence of their credentials during the manual verification process.
Public Listing Requirements for Organisations:
Organisations seeking to list public profiles must ensure:
Services offered are delivered by qualified professionals meeting the individual eligibility criteria above.
Compliance with relevant UK regulatory, ethical, and legal standards.
Documentation verifying the organisation’s credentials and the qualifications of listed practitioners is provided during the manual verification process.
Remote Practice Outside the UK:
Therapists or organisations operating remotely from outside the UK may still list public profiles if they:
Provide services to UK residents.
Meet the individual or organisational public listing requirements detailed above.
Adhere to all relevant UK regulations for therapy services provided to UK residents and applicable local laws for cross-border service provision.
Verification for public profiles will be conducted manually, and you will be contacted via email to provide the required documents. Mindscape reserves the right to reject or remove public profiles that do not meet these eligibility criteria or fail to provide sufficient evidence during verification.
Accounts
Accuracy of Information: Individual and organisational users are responsible for providing accurate and truthful information during registration. Misrepresentation of identity, qualifications, or other details is prohibited and may result in account termination.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Organisations must ensure that access to their account is managed responsibly and that only authorised personnel can act on their behalf.
Subscription & Billing
Free to Join: Joining Mindscape is free.
Paid Public Listings: Public listing requires a monthly subscription.
Automatic Renewal: Subscriptions automatically renew unless cancelled before the next billing cycle.
Cancellation Policy:
Individual users and organisations may cancel subscriptions at any time.
If cancelled part way through the month, services will continue until the end of the current billing period.
Refunds: Mindscape does not offer refunds for subscription fees.
Termination by Mindscape:
Mindscape reserves the right to terminate any subscription or account at its discretion if there is a violation of these Terms of Service or misuse of the platform. In such cases, refunds will not be issued for the remaining subscription period.
AI and Tool Usage
Mindscape provides AI-powered tools, including Ava, to assist therapists, organisations, and clients. These tools are designed to supplement—not replace—professional judgment or therapy practices. Mindscape is not liable for errors or limitations in AI-generated outputs.
Platform Use
User Conduct: All users agree not to engage in:
Misrepresentation of identity, qualifications, or services.
Harassment, discrimination, or posting offensive content.
Unauthorised access to other users' accounts or sensitive information.
Marketplace: If you or your organisation sell resources (e.g., books, courses, guides):
You are responsible for the accuracy, legality, and quality of offerings.
Mindscape is not liable for disputes between buyers and sellers.
Data Privacy and Security
Data Collection: Mindscape collects and processes personal data in accordance with our Privacy Policy. This includes information provided during account registration, profile setup, and usage of the platform.
Data Protection:
Your data is stored securely and handled in compliance with applicable data protection laws, including the UK GDPR.
We implement industry-standard measures to protect against unauthorised access, loss, or misuse of your data.
Sharing of Information: Mindscape will not share your personal information with third parties without your explicit consent, except as required by law or for essential platform operations (e.g., payment processing).
User Responsibility: You are responsible for protecting any sensitive data shared through the platform and ensuring compliance with professional confidentiality obligations.
Data Breaches: In the event of a data breach that affects your information, we will notify you promptly as required by law.
Dispute Resolution
Mindscape is not responsible for disputes arising between therapists, organisations, and clients or between users of the platform. Therapists and organisations are responsible for professional relationships and outcomes with clients.
Content Ownership
Your Content: By posting content (e.g., profile information, resources) on the platform, individual users and organisations grant Mindscape a license to display it. Ownership of intellectual property remains with the content creator.
Moderation: Mindscape reserves the right to remove or moderate content that violates these terms or is deemed inappropriate.
Service Availability
Mindscape strives to ensure uninterrupted platform access but cannot guarantee availability during maintenance, technical issues, or other interruptions.
Third-Party Services
Mindscape integrates third-party services (e.g., payment gateways) for functionality. Mindscape is not liable for errors, delays, or disputes caused by third-party providers.
Insurance and Professional Responsibility
Therapists and organisations are responsible for holding appropriate professional indemnity insurance and adhering to professional and ethical standards of practice.
Organisations must ensure all listed professionals meet these standards.
Liability Limitation
Mindscape provides a platform to connect therapists, organisations, and clients but is not responsible for the services provided by therapists or organisations. Mindscape disclaims all liability for:
Professional interactions between therapists, organisations, and clients.
Any harm resulting from platform use or technical issues.
Changes to Terms or Pricing
Mindscape reserves the right to update these Terms of Service or change subscription pricing. You will be notified in advance of any material changes.
